Who we are
Able is the trading name of Able Health Care Limited, registered in England and Wales under company number 06604185. Our registered office is 3rd Floor, Argyle House, Joel Street, Northwood, Middlesex, HA6 1NW. We are registered with the Information Commissioner's Office (ICO) under registration number ZA116916.
Able Health Care Limited is a data controller. That means we are responsible for deciding how we collect, hold and use personal information about you. This notice explains what we collect through this website, why we collect it, how long we keep it and what your rights are, in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
If you have any questions about this notice or how we handle your information, email us at info@ablehealthcare.co.uk or write to us at the address above.
What this notice covers
This notice covers this website and the information you share with us through it. Information we hold about the children and young people in our care, our staff, and the local authorities and professionals we work with is handled under separate privacy notices, which we provide at the point we collect it and which are available on request.
We may update this notice from time to time. The date at the top tells you when it was last changed.
Data protection principles
We comply with data protection law. This means the personal information we hold about you must be:
- Used lawfully, fairly and in a transparent way.
- Collected only for valid purposes that we have clearly explained to you, and not used in any way that is incompatible with those purposes.
- Relevant to the purposes we have told you about and limited to those purposes.
- Accurate and kept up to date.
- Kept only as long as necessary for the purposes we have told you about.
- Kept securely.
The information we collect through this website
Personal information means any information about an individual from which that person can be identified, directly or indirectly. It does not include anonymous data.
When you contact us. If you use our contact form we collect your name, your email address, your phone number if you give it, and whatever you write in your message.
When you enquire about working with us. Our careers pages let you register interest in a role. We collect your name, your contact details and your answers to a short set of qualifying questions, such as your right to work in the UK and your experience in residential childcare. The full application, including safer recruitment checks, takes place outside this website and is covered by our recruitment privacy notice, which we send to you at that stage.
When you make a referral enquiry. If you are a social worker or commissioner enquiring about a placement, we collect your name, role, organisation and contact details, together with a short outline of the young person's needs, age, legal status and the type of placement being sought. We keep this form deliberately light. Full case information is shared with us through secure channels once we are in conversation, not through this website.
When you browse the site. We collect information about how the site is used, such as which pages are visited, how long people stay, and what device and browser they use. This is collected through cookies and similar tools, explained below, and only with your consent where the law requires it.
Information about children and young people
Referral enquiries may include sensitive information about a young person, such as their health needs, ethnicity, looked after status or assessment history. This is special category data. We only ask for what we need to assess fit, and we rely on the safeguarding and social care conditions set out in the Data Protection Act 2018 to process it. We expect the person submitting the form to be authorised by their organisation to share it.
This website is not aimed at children and we do not knowingly collect personal information from anyone under 16 through it. If you believe a child has sent us information through this site, contact us and we will delete it.
How we use your information and our legal basis
We will only use your personal information in the ways the law allows. Most commonly, we use it in the following circumstances:
- To respond to an enquiry you have sent us.
- To process a job application or respond to an enquiry about a possible job with us.
- To assess whether a placement might be a good fit and to provide our services.
- Where we need to perform a contract we have entered into with you.
- Where we need to comply with a legal or regulatory obligation.
- Where we send you information you have specifically requested from us.
- Where processing is necessary for our legitimate interests, or those of a third party, and your interests and fundamental rights do not override them. Where we rely on this, we document our considerations in a legitimate interest assessment.
For contact and careers enquiries, we rely on our legitimate interest in responding to people who get in touch and in recruiting safely for the children in our care. For referral enquiries, we rely on our legitimate interest in providing placements and, because the enquiry concerns a child in the care of a local authority, on the substantial public interest in safeguarding children and providing social care. For analytics cookies, we rely on your consent.
We may also use your information for business management and planning, including accounting and auditing; to deal with any legal dispute involving you; to prevent fraud; and to keep our systems secure, including preventing unauthorised access and the spread of malicious software. Some of these grounds overlap, and more than one may apply to the same use of your information. We do not use your information for automated decision making and we do not sell it.
Who we share it with
We use a small number of suppliers to run this website and handle enquiries. Webflow hosts the site and processes form submissions on our behalf. Google provides our analytics through Google Analytics 4. Each supplier is bound by a contract that requires them to keep your information secure and to use it only on our instructions.
Where a referral leads to a placement, information is shared with the relevant local authority and the other professionals involved in the young person's care, as required by law and by our regulatory duties. We will disclose information where we are required to by law, by a court, or by a regulator such as Ofsted.
Where your information is stored
Some of our suppliers, including Webflow and Google, store information on servers outside the UK, mainly in the United States. Where that happens, the transfer is covered by the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses, so your information is protected to the same standard as it is here.
How long we keep it
We only keep your personal information for as long as we need it for the purposes we collected it for, including to satisfy any legal, accounting or reporting requirements. Details of our retention periods are set out in our retention policy, which is available on request. As a guide, contact enquiries are kept for 12 months after our last exchange with you, careers enquiries that do not lead to an application are kept for 6 months so we can contact you about similar roles, and analytics data is kept for 14 months.
Cookies
Cookies are small files placed on your device when you visit a website. We use essential cookies to make the site work, for example to remember your cookie choices. These cannot be switched off.
We use Google Analytics 4 to understand how the site is used. These cookies are only set if you accept them in the banner shown when you first visit. You can change your choice at any time through the cookie settings link at the bottom of every page.
How we protect it
The site is served over HTTPS. Form submissions are encrypted in transit and access to them is limited to the staff who need it to respond. We do not ask for, and you should not send, detailed case records, medical documents or anything else highly sensitive through the website forms.
Your rights
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your details change. Under data protection law you have the following rights:
- Access. You can ask for a copy of the personal information we hold about you. We will ask for a suitable form of identification and, under normal circumstances, respond within one calendar month of receiving it. No fee is payable, although we may charge one if a request is clearly excessive or repetitive.
- Correction. You can have any incomplete or inaccurate information we hold about you corrected.
- Erasure. You can ask us to delete your personal information where there is no good reason for us to continue processing it.
- Objection and restriction. In certain circumstances you can object to our use of your information, or ask us to suspend processing it.
- Transfer. You can ask us to transfer your personal information to a third party.
- Withdraw consent. Where we rely on consent, you can withdraw it at any time without giving a reason. Once we receive your request we will stop the processing you consented to, unless we have another legal basis for it.
To exercise any of these rights, email info@ablehealthcare.co.uk.
You also have the right to complain at any time to the Information Commissioner's Office (ICO) about how we handle your information, at ico.org.uk or on 0303 123 1113. We would ask you to raise it with us first so we have the chance to put it right.
